Applying to the European Court of Human Rights. Applying to the Constitutional Court of the Russian
   On February 7-8, 2012 Interregional Public Charitable Organization “Faith, Hope, and Love” conducted a seminar on the subject “Applying to the European Court of Human Rights. Applying to the Constitutional Court of the Russian Federation” in Pyatigorsk thanks to the support of the U.S. Agency for International Development.

  

Representatives of machineries of the Commissioner for Human Rights in Stavropol Krai and the Republic of Ingushetia, representatives of human rights organizations of the North Caucasus Federal District, practicing lawyers, lawyers of human rights organizations (“Nizam” Regional Public Fund, “Vesta” Interregional Public Organization, Regional Public Organization for Support of Refugees and Forced Migrants, “Memorial” Human Rights Center, “Tolerance” Noncommercial Partnership, the Russian Children’s Fund, “Tvori Dobro” Regional Public Organization), and students of institutes of higher education of the NCFD took part in the seminar.

    Specialists in the field of applying to the European Court of Human Rights and the RF Constitutional Court were invited as speakers.

   The purpose of the seminar was the training, the promotion of the improvement of professional skills of the trainees in the field of human rights protection, the strengthening of cooperation between human rights organizations, the sharing of experience, the involvement of advocates in rendering free assistance to vulnerable persons, the building of capacity of NGOs’ employees in the field of applying to the European Court of Human Rights and the RF Constitutional Court.

   Ekaterina S. Shugrina, a Doctor of Science of Law, a professor of the chair of Russian constitutional and municipal law of the Kutafin State Law Academy of Moscow, told of the interaction between the RF Constitutional Court and the European Court of Human Rights, as well as of the procedure for applying to the Constitutional Court of the Russian Federation.

   Sergey A. Golubok, an advocate of the “Juri Shmidt &Partners” Bar of the Saint-Petersburg City Bar of the Advocatory Chamber of Saint-Petersburg, a Candidate of Science of Law, spoke about procedural principles for considering individual complaints by the European Court of Human Rights, legal positions of the ECHR on the protection of migrants’ rights, as well as told of methods of interpreting the European Convention for the Protection of Human Rights and Fundamental Freedoms and protocols to it which are used by the ECHR. Sergey A. gave practical examples of the most notorious cases examined by the ECHR with respect to Russia and European countries.

   Olga P. Tseitlina, an advocate of the “Jiri Shmidt &Partners” Bar of the Saint-Petersburg City Bar of the Advocatory Chamber of Saint-Petersburg, reviewed the practice of the ECHR on extradition and expulsion, and conditions of custody. Practical examples on the CIS-countries were considered.

   The consideration of issues concerning the procedural foundations for applying to the European Court of Human Rights, periods and the procedure of examination of cases by the Court aroused peculiar interest of the participants.

    Human rights defenders and NGO lawyers, who, as a rule, have no sufficient knowledge and skills on the procedure of applying to the European Court, are forced to apply to the ECHR on the most complicated situations of individuals.

   NGOs can not fulfill their tasks on human rights protection in full measure without regular training, without sufficient knowledge of both Russian legislation and international one, without timely improvement of their professional skills.

   The analysis of training courses organized and conducted by IPCO “Faith, Hope, and Love” before shows a great importance of conducting such events in order to improve the quality of work of NGO lawyers and advocates.
