Effective work of a lawyer in court

 

On November 23-24, 2017 an Interregional Public Charitable organization "Faith, Hope, and Love" with the support of the Office of the United Nations High Commissioner for Refugees in the Russian Federation conducted a seminar on the subject: "Effective work of a lawyer in court" in Moscow.

Candidates of legal science, associate professors, representatives of the Lawyers Chamber of Moscow, as well as Lawyers Chambers of Moscow and Lipetsk regions were invited as speakers.

The seminar was attended by acting attorneys, as well as lawyers of non-profit organizations from various regions.

During the seminar the following issues were discussed:

  • Psychological portrait of the judge. Features of the perception of information in the trial. Perception barriers and ways to overcome them. The judicial process as a source of a conflict situation. Skills of attorney's behavior in a conflict situation.
  • Ethical violations committed by judges during the trial.
  • Objections to the actions of the presiding judge: normative regulation, permissible and unacceptable form and content of objections by the lawyer.

  • Features of evidence investigation in the trial.
  • Features of the involvement of evidence in the trial and the call of witnesses.
  • Speech of the defender / representative in the process, in the debate of the parties / with the introductory statement in the appeal. Practical skills of speech in arbitration court.
  • Procedural compulsion.

Reports and lectures of the speakers were given in the form of discussions, and also the work was carried out in small groups, during of which the participants were able to get explanations on the issues they were interested in on the presented topics, and to analyze the practical cases encountered during the trials.

An analysis of the feedback from the workshop shows that it is extremely important to carry out similar activities to improve the quality of work of NGOs lawyers and attorneys.
